Uncontested vs. Contested Divorces

In Illinois, divorces can either be uncontested or contested. With more than 18 years of combined experience, our attorneys can help clients with any type of uncontested and contested divorce, of any complexity.

Uncontested divorces are less expensive and take less time, but are unfortunately rare. They involve much more than simply agreeing to have a divorce on the basis of irreconcilable differences. The couple must agree upon every aspect of the separation, from child custody and child support to spousal support and the division of assets and debts.

Contested divorces are more common, and do not necessarily require going to court. Many are resolved through negotiation and settlement. Our attorneys strive to find a settlement, so as to save our clients money and stress, but can take a case to court if need be.

Community vs. Non-Community Property

The division of assets in a divorce can be complex, and can be the source of many disputes. Community property is property gained during the marriage, and thus should be split equally in a divorce. Non-community property is property gained by one spouse before a marriage, and thus should be awarded only to the original owner.
